What to do after an arrest in San Francisco
By James Paul Owens ·
Being arrested is frightening and disorienting. The decisions you make in the first hours and days can affect bail, charges and the eventual outcome of your case.
Stay silent and ask for a lawyer
You have the right to remain silent. Anything you say to police can be used against you, even if you believe it will help. Say clearly: "I want to speak with a lawyer."
Do not discuss the case on the phone or online
Calls from jail are recorded, and social media posts and messages are routinely used as evidence. Keep conversations about your case between you and your attorney.
Know your court date
If you were cited or released, your paperwork lists a court date. In San Francisco, criminal cases are heard at the Hall of Justice. Missing a court date can lead to a warrant.
Contact a defense attorney early
An early lawyer can argue for release, contact the prosecutor before charges are filed, and preserve evidence such as video that may disappear.
